Terms of Service

1. Acceptance of Terms

By accessing or playing Tygaria ("the Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Game. These Terms constitute a legally binding agreement between you and Tyga.Cloud Ltd ("Company", "we", "us"), a company registered in England and Wales (Company No. 14643275).

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction (whichever is greater), to create an account and play the Game. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age and to terminate accounts that do not meet this requirement.

3. The Service

Tygaria is an online multiplayer role-playing game featuring AI-powered non-player characters, arcade mini games, crafting systems, player settlements, clan competitions, and real-time multiplayer interactions. We reserve the right to modify, update, suspend, or discontinue any aspect of the Game at any time, with or without notice. We do not guarantee uninterrupted access to the Game.

4. Accounts

You are responsible for maintaining the confidentiality of your login credentials. You must not share, sell, trade, or transfer your account to any other person. One account per person. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms without notice or refund.

5. Virtual Currency & Purchases

The Game features virtual currencies including "Gold" (earned through gameplay) and "Crystals" (premium currency that may be purchased with real money or earned slowly in-game).

No real-world value: Virtual currencies and virtual items have no monetary value outside the Game. They cannot be exchanged for real currency, transferred between accounts, or redeemed for cash.

Refund policy: Purchases of Crystals are final. Refunds may be granted at our sole discretion within 14 days of purchase if no Crystals have been spent. Platform/processing fees are non-refundable. This does not affect your statutory consumer rights under UK or EU law.

Balance adjustments: We reserve the right to adjust virtual currency balances, pricing, earn rates, and the availability of virtual items at any time to maintain game balance and economy.

6. Arcade & Mini Games

The Game includes arcade-style mini games played with in-game Gold (virtual currency only). These games involve elements of chance and skill, and are for entertainment purposes only. No real money is wagered, won, or lost through mini games. All game outcomes are determined by server-side cryptographic random number generation. House edge percentages are built into game mathematics to maintain the in-game economy. Mini game access may be limited by daily free play allowances.

7. AI-Powered Characters

The Game features AI-powered non-player characters that generate dynamic, contextual responses using artificial intelligence (powered by AINPCEngine). AI characters may produce unpredictable or unexpected content. We make reasonable efforts to filter inappropriate content but cannot guarantee all AI responses will be appropriate.

Not real advice: AI characters do not provide real financial, legal, medical, or professional advice of any kind. All AI character dialogue is fictional entertainment.

No AI training: Your conversations with AI characters are used solely to maintain NPC memory and personality within the Game. We do not use player conversations to train external AI models.

8. Player Conduct

You agree not to: use cheats, bots, automation tools, or exploits; harass, bully, threaten, or abuse other players; impersonate other players or staff; attempt to access other players' accounts; reverse-engineer, decompile, or modify the Game client or server; use the Game for any illegal purpose; exploit bugs or glitches for unfair advantage (you must report them); engage in real-money trading of accounts, items, or virtual currency; use offensive, discriminatory, or hateful language in chat.

Violations may result in temporary suspension, permanent ban, or forfeiture of virtual items and currency, at our sole discretion.

9. Multiplayer & Chat

The Game includes real-time multiplayer features including world chat, player trading, and clan interactions. You are solely responsible for content you communicate to other players. We may monitor chat for safety and moderation purposes. We are not responsible for interactions between players. Some characters in the Game are AI-controlled -- this is a core feature and players should not expect to always distinguish between AI and human participants.

10. Intellectual Property

All Game content, including but not limited to code, artwork, music, sound effects, character designs, world designs, game mechanics, and user interface elements, are the exclusive property of Tyga.Cloud Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and play the Game for personal, non-commercial use. You may not copy, distribute, modify, create derivative works from, publicly display, or commercially exploit any Game content without our prior written consent.

11. Third-Party Services

The Game relies on third-party services including AINPCEngine (NPC dialogue), payment processors (for Crystal purchases), and cloud hosting providers. We are not liable for failures, outages, or issues caused by third-party services. Third-party services are subject to their own terms and privacy policies.

12. Limitation of Liability

The Game is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, our total aggregate liability to you for any claims arising from your use of the Game shall not exceed the greater of: (a) the total amount you have paid us in the 12 months preceding the claim; or (b) GBP 100.

We shall not be liable for: loss of virtual items, currency, or game progress; interruptions to service; actions of other players; AI-generated content; or any indirect, incidental, consequential, or punitive damages.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

13. Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your account at any time for violation of these Terms or for any reason at our discretion. Upon termination, your licence to use the Game ends immediately. Virtual currency and items are forfeited upon termination. Data will be retained for 30 days to allow account recovery, after which it will be permanently deleted (except where retention is required by law).

14. Dispute Resolution

Before initiating any formal proceedings, you agree to contact us at legal@tyga.cloud and allow 30 days for informal resolution.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in the EU, you retain the right to bring proceedings in your country of residence.

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via in-game notification or email. Continued use of the Game after changes constitutes acceptance of the updated Terms. If you disagree with changes, you must stop using the Game and may request account deletion.
